In these Terms, “KOYA”, “we”, “us” and “our” refer to Koya Corporation Pty Ltd trading as KOYA Wheels Australia. “You” and “customer” refer to the person or entity placing the order.
These Terms govern your use of the KOYA Wheels website and your purchase of wheels, accessories or related products from KOYA. By placing an order, paying an invoice or approving final specifications, you confirm that you have read and accepted these Terms.
If you place an order on behalf of another person, company or organisation, you confirm that you have authority to accept these Terms on their behalf.
We take reasonable care to keep product information accurate. Images, rendered designs and on-screen colours are illustrative and may appear different depending on lighting, screen settings, wheel size, profile and selected finish.
KOYA wheels are made, machined, drilled or finished to order using the approved specification. This may include the design, diameter, width, offset, PCD, centre bore, profile, load requirement and finish.
Before production, KOYA may provide an order confirmation, invoice, drawing or written specification for approval. You must check all information carefully and immediately advise us of any error.
Once you have approved the specification and production has commenced, the order cannot be changed or cancelled and is not eligible for a change-of-mind return or refund. This is because the product is being manufactured or finished specifically for your order and may not be suitable for resale.
This clause does not limit any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Unless otherwise stated, prices are in Australian Dollars (AUD) and include GST. Freight, special finishes, design changes, non-standard engineering, accessories, import duties and other charges may be additional.
Full payment is required before production begins unless KOYA agrees otherwise in writing. An order is not confirmed until payment has cleared and all required specifications have been approved.
Prices may change before an order is confirmed. Any later customer-requested change accepted by KOYA may result in additional cost and a revised completion estimate.
Production and completion dates are estimates, not guaranteed dates. Custom manufacturing may be affected by material availability, machining, finishing, quality checks, supplier delays and events outside KOYA’s reasonable control.
We will take reasonable steps to complete the order within the estimated period and will advise you if a material delay becomes known. A production delay does not automatically give a right to cancel a made-to-order product, except where required by law.
Small variations in colour, gloss level, texture, brushed pattern or polished appearance may occur between batches, samples, photographs and finished products. These normal production variations are not defects unless the goods fail to meet an agreed specification or a consumer guarantee.
KOYA ships to Australian states and territories. Delivery after dispatch is generally estimated at 1–14 business days, depending on the carrier and destination. Delivery dates are estimates only.
International shipping is available to selected destinations. Import duties, taxes, customs charges, brokerage fees and local compliance costs are the customer’s responsibility unless agreed otherwise in writing.
You must provide a complete and accurate delivery address. Additional carrier costs caused by an incorrect address, failed delivery or requested redirection may be charged to you.
If KOYA arranged the freight and the order is delayed, lost or arrives damaged, contact KOYA promptly with your order details, photographs and any carrier documentation so we can investigate and assist. Where possible, note visible packaging damage with the driver before accepting the shipment.
Reporting damage promptly helps us investigate a freight claim, but it does not remove any rights you may have under applicable law.
You must inspect all wheels after delivery and before tyres are mounted. If a wheel appears damaged, incorrect or inconsistent with the approved specification, do not fit it and contact KOYA promptly.
Installation must be completed by a suitably experienced wheel and tyre professional. Before the vehicle is driven, the installer must verify:
Damage caused by tyre fitting, incorrect hardware, incorrect torque, improper installation, vehicle contact or unauthorised modification is not a manufacturing defect. Mounting a tyre does not remove rights that cannot be excluded by law, but it may affect whether damage was caused by manufacture or installation.
Motorsport, track, drift, drag, time attack, off-road competition and similar use can expose wheels to loads, impacts, heat and fatigue beyond normal road conditions. You must disclose this intended use before ordering so KOYA can discuss an appropriate product and specification.
Unless KOYA has expressly agreed in writing that a wheel package is being supplied for a particular competition program, damage caused by motorsport, competitive use, track events, impact, overloading or abnormal use is excluded from KOYA’s voluntary warranty.
You are responsible for pre-event and post-event inspection, maintenance, correct tyre pressure, fastener torque and determining whether continued use is safe. Any damaged or suspect wheel must be removed from service immediately.
A voluntary warranty exclusion does not exclude consumer guarantee rights that apply under the Australian Consumer Law. Any claim will be assessed according to the product, represented purpose and cause of the issue.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
KOYA does not offer returns or refunds merely because a customer changes their mind about a correctly supplied custom-made product. However, if goods are faulty, unsafe, materially different from their description or otherwise fail to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and whether the failure is major or minor.
KOYA may request proof of purchase and a reasonable opportunity to inspect or assess the product before determining the appropriate remedy.
To the maximum extent permitted by law, KOYA is not responsible for loss, damage or expense caused by:
Where liability cannot lawfully be excluded, KOYA’s liability will be limited only to the extent permitted by law. Nothing in this clause limits liability for conduct or loss that cannot lawfully be limited or excluded.
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and courts hearing appeals from them, subject to any rights available under applicable law.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply. We may update these Terms from time to time. The version applying to an order is the version in effect when that order is confirmed, unless the parties agree otherwise in writing.
